Unionized workers are represented by the International Union of Operating Engineers Local 115. In Canada, there is no law against random drug and alcohol testing. It is therefore permitted in a non-unionized context. In a unionized context, random drug and alcohol testing is permitted when it is an appropriate exercise of management rights, in accordance with the current collective agreement. The arbitrators decided that random drug and alcohol testing is useful when there is a major drug or alcohol problem in a given workplace. Teck firmly believed that he had reached the threshold. The arbitrator disagreed.

We are disappointed with the arbitrator`s decision. However, as a result of this decision, we have suspended random drug and alcohol testing at our steel sites in British Columbia. We are currently examining possible next steps to ensure that the safety, health and well-being of our staff, obtained through a survey, is not lost.
